What is an expert witness?
An expert witness is someone whose opinion on a specialist subject is admissible as evidence in court proceedings.
Who instructs the expert?
Usually in court proceedings, instruction is from the solicitors for the parties. This can be a joint instruction by both parties (a single joint expert), or by one party only (a party appointed expert). The court must agree that expert evidence is required, and the report is addressed to the court.
What if separate advice is needed?
We can also give advice as a shadow expert. This is where the advice is provided to the party, not to the court.
Where can an expert accountant help in separation or divorce?
We can assist both the parties and the court during matrimonial proceedings, providing advice and support on matters such as business and company valuations, capital extraction, income and tax, and regarding the allocation of matrimonial assets.
